Judicial officers to deal with violations of Labour Law

The Minister of Labour has issued a decision on determining the procedures for dealing with private sector establishments that violate the provisions of the Labor Law.

The decision is based on the Labor Law issued by Royal Decree 53/2023, and Ministerial Resolution 10/2013 specifying the procedures and controls for dealing with private sector establishments that violate the provisions of the Labor Law and the decisions regulating it,

As per Article 1, judicial law enforcement officers are responsible for registering and controlling violations committed by employers and workers in violation of the provisions of the Labor Law and the decisions issued in implementation thereof.

Article 2 states that those authorized to have judicial police status carry an identification card that includes a statement of this capacity, and they must disclose their legal capacities when carrying out the tasks assigned to them whenever they are asked to do so.

Article 3 states that If they detect a violation, those authorized to act as judicial officers must write a report, which must include

1 - The date, time, and place of opening the report and the type of violation.

2- The name and signature of the person who prepared the minutes.

3 - The name and title of the person against whom the procedures were conducted, whether he is the owner of the establishment or one of his employees.

4 - The signature of the facility owner, or one of his employees who attended the incident, and a copy of it is delivered to him,

If he refuses to sign or receive the copy, this shall be recorded in the record.

Article 4 states that judicial officers prepare a memorandum on the subject of the violation that includes proof of the violation, and submit it to the relevant department director, or his replacement.

Article 5 states that if the violation is proven, the competent department director or his replacement shall suspend all or some of the violation

Services provided by the facility, are as follows:

1 - Issuing work permits for the non-Omani workforce.

2- Renewing the work permit for the violating worker.

3- Amend the data of the violating worker.

4- Recording the data of the violating worker.

5 - Transferring the services of the violating worker.

6- Recording a notice of leaving work against the violating worker.

7 - Cancellation of the violating worker’s notice of leaving work.

Article 6 states that the suspension of services stipulated in Article 5 of this decision will be lifted after the violation has ceased or payment of the the fine assigned by decision of the competent department director or his representative
